At Xuereb Law Group, we represent banks, credit unions, judgment creditors, and small and medium-sized businesses in all aspects of the debt collection process. This includes everything from demand letters, lawsuits, representation of creditors in a bankruptcy, mortgage foreclosure, land contract forfeiture, and judgment collection. Under the Fair Debt Collection Practices Act, a Federal Act which regulates debt collectors, there may be ramifications to your specific collection issue(s). We are well versed and well experienced in all state and federal aspects of debt collection in order to better serve our clients.
Bankruptcy is a complicated process, made even more confusing by the different rights afforded creditors under each of the individual chapters of bankruptcy. Knowing your rights and the likelihood of collection is important. We have years of experience in representing creditors in bankruptcy for each of the individual and business chapters. We will be able to quickly and efficiently evaluate your claim in bankruptcy, and work with you or your business in order to maximize any potential recovery of your debts. We can also represent you or your business through adversary proceedings that have the potential to disgorge payments and transfers made to you prior to the bankruptcy.
Mortgage foreclosure in Michigan can be by advertisement or judicial act. The vast majority of foreclosures are by advertisement. A foreclosure by advertisement is a special, non-court process that is supervised by the County Sheriff. A judicial foreclosure is a specialized lawsuit where the court will order the home sold and the proceeds paid to the mortgage company. The options a lender has in foreclosure will depend on the wording of the mortgage, and we have experience in both judicial foreclosures and foreclosures by advertisement.
Land contract forfeiture is a judicial action where a land contract is terminated. It can be necessary when someone breaches the terms of the land contract for any reason. A land contract vendee can also choose to foreclose depending on the language contained in the land contract.
Judgment collection is another aspect where we help in the collection of debts. Wage garnishments, bank levies, personal property executions, and judicial liens are all tools provided for collection under the laws of Michigan. With our in depth experience in using all of these tools, we help ensure our clients receive the money they are owed.
